Terms of Service

These Terms of Service ("Terms") govern your use of bashbenzo.com and any services booked through it, operated by BASHBENZO, a photography and production studio run by Sebastian "Benzo" Thomas, based in Atlanta, Georgia. By using this site or booking a service, you agree to these Terms.

BASHBENZO provides commercial and personal photography and video production, including Depot Club (brand launch photography and video for clothing brands), Portrait and Executive sessions, and a Shop selling Depot Club apparel. Full package details, pricing, and inclusions are listed on the relevant pages of this site and are confirmed with you at the time of booking.

A booking is confirmed once a 50% deposit has been paid and, where applicable, a service agreement has been signed. This deposit is non-refundable under any circumstances, including cancellation, rescheduling, or change of mind, except where required by law. The remaining balance is due upon delivery of your final files, before final assets are released, unless otherwise agreed in writing.

Payments are processed by Stripe. By making a payment, you agree to Stripe's terms of service in addition to these Terms.

You may request to reschedule a confirmed shoot date with at least 5 business days' notice, subject to our availability. Rescheduling within 5 business days of the scheduled date, or a no-show, may require a new deposit to rebook.

For Depot Club bookings where you ship product to our studio rather than attending in person, you are responsible for packaging, insuring, and shipping your product, and for providing tracking information promptly. We handle shipped product with reasonable care but are not liable for loss or damage in transit, before receipt, or after a return shipment has been handed to a carrier.

Shop purchases are processed by Stripe at checkout. Product photos, sizing, and specifications are listed on each product page. Orders are fulfilled by our production partner and shipped to the address provided at checkout.

Delivered assets come with the usage rights specified for your booked package. Unless otherwise agreed with you in writing prior to your shoot, BASHBENZO retains the right to use images and video from your session for its own portfolio, marketing, and self-promotion, including on bashbenzo.com and social media.

All site content, including photography, video, design, and copy not delivered to you as part of a booking, is the property of BASHBENZO and may not be reproduced without permission.

You agree not to use bashbenzo.com for any unlawful purpose, to attempt to gain unauthorized access to our systems, or to interfere with the site's normal operation.

bashbenzo.com and our services are provided "as is." We do not guarantee that the site will be uninterrupted or error-free. Delivery timelines are estimates and may be affected by factors outside our control.

To the fullest extent permitted by law, BASHBENZO's total liability arising from any booking or use of this site is limited to the amount you paid for the relevant service. BASHBENZO is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunity.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising from these Terms or a booking will be resolved in the courts of Fulton or DeKalb County, Georgia.

We may update these Terms from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of bashbenzo.com after a change means you accept the updated Terms.
